Embroidery mistake

Right, Mr.Why-don't-I-learn had a sample club jacket made, and very nice it was/is to. So on the basis of that more orders were forthcoming and we have now taken delivery. On inspection I noticed that the 'order' had been embroidered through the mesh lining, rather than beneath it as per sample. I phoned and queried it and it appears that a relatively new machinist wasn't aware of the access zip, and was half-way through the order when it was realised and put right. Bearing in mind that these jackets are useless to anyone else, and clearly not right, what would you expect from the embroidery firm?

Speaking as someone who works as a printer/embroiderer Id ask for my money back. The place where I work would never have let that order go out and would have made sure the mistake was corrected.

I would certainly expect that the jackets that were wrong to be replaced.

In fairness to the company concerned the 'main man' was not aware of the situation, whereas it appears 2IC was (he's the one that spotted the error mid-stream), so they did say that they didn't think it would make any difference overall, but it really is up to the unlucky ones to decide how they feel about the finished items.
My main question is really (considering the club have had a good relationship with these guys up 'til now), what would be a reasonable compromise?

We had new polo shirts etc last year after we had registered our new colours.I specifically asked for RIGHT chest embroidery, for all but 2 garments.When I arrived to collect them, I am so glad that I decided to check the order, as I discovered that they were all LEFT sided.
The order was done again , as originally requested.
As you rightly point out, though , the other stuff was useless to anyone else.So the company offered it to us at half price, and probably three quarters of the items were snapped up as extra kit.

In your case, the order has not been filled as per the sample, don't accept it. The company should redo everything to your satisfaction. Good luck.

I wouldn't accept 2nd best... its not your fault they are not correct. If it was me waiting for my new jacket I also wouldn't be best pleased with you if you accepted that mistake on my behalf.

I certainly wouldn't accept it on anybody else's behalf, what I'm thinking is if the right terms are negotiated, would those affected accept the garments 'as is'. Question is 'what are the right terms?'

nothing so far - they're waiting on the response from those concerned.

(incidently, no individual has paid yet - apart from me for the 'sample' ie my jacket - the club has paid up front and the individuals should pay on receipt of the items)

There would be no question in my mind to be honest.
The order has not been filled as per the written contract, therefore it should be redone as per specification, and then the company may offer the badly machined ones at a heavy discount for anyone that wants to buy them.
