Who's liable for injury?

After reading the 'too close' thread I started to think about being damaged by badly maintained equip.
Anyone know who's liable if an archer get's injured at a comp? or on a club day ?

Depends on who set the equipment up and how long before the problem occurred.
All retailers should have their own insurance, if it was set up by someone at the club, if they are not a qualified coach, the GNAS insurance may well not cover you, like all insurance companies, if they can get out of paying, they will.

ooh, I feel another great archery myth coming on here.

What makes you say gnas insurance wont cover you and what does equipment setup have to do with being a qualified coach?

gnas insurance covers "normal" archery activities. removing the bolts from a compound doesnt consititute normal activity.

Surely the person responsible is the person liable.
If its your equipment, you are responsible for maintaining it in good order.
Insurance is for accidents, not negligence.

how do you differentiate between an accident and negligence.

your equipment may not be up to standard but it doesn't mean ur negligent.

i would say any obvious issue would be picked up by an archer in the versinity.

so 100% of the time it would be an accident.
covered by 3rd party insurance of GNAS

are you going to shoot a bow knowing its faulty with only 3rd party cover.

easier ways to commit suicide.

I think it would be down to the usual 'what a reasonable person would expect' in this case I would guess it would be based on the assumption that a bow must be maintained and used respecting the safety of others.

If however you have just bought the bow from shop X and it explodes on the shooting line within the first few sessions I think the dealer could be held to account.

If the person is a beginner shooting a club bow then I think the club would be liable.
